Your information will be collected and held by O'Neill Wetsuits Ltd, incorporated in 1999. O’Neill Wetsuits is registered with company’s house UK, company number 03803234, we are registered with the information commissioner’s office (ICO) in the UK.

O’Neill Wetsuits LTD will only collect and use your personal information in accordance with data protection laws. We use your personal information to process orders, deliver goods, take payments, manage your account and to provide services and support. We collect some financial information for credit checks and credit account purposes, your personal data will be used to send you communications pertaining to your orders and other requested services, this may include WhatsApp messages.

Who will it be shared with, who has access to your information?

Your information will be held on our internal servers and as paper copies at our offices in Midhurst. Employees of the company will only have access to your information if they need it to provide our goods and services, those processing your information will do so only in an authorised manner and are subject to a duty of confidentiality. Our IT support and software providers, Technology Means Business Ltd and K3 Business Technology Group PLC have access to this information for IT support purposes,  other than this we do not generally share this information with any third parties, where we do use data processors to act on our behalf to provide our services, we will not pass on details to any third party data controller without your express prior consent unless we are required by law to do so.                                                                                                              

How you can access, update or delete your information?

Under the GDPR Act 25th May 2018, you have the right to access or rectify your data and the right to the erasure of your data. If you would like a copy of the information or to erase the information that we hold about you or to remove consent to the processing and holding of your data, you can contact us by phone, email or letter using the contact details at the top of this document or by any other means provided on the contact page of our website owetsuits.com. If you believe that any information we are holding about you is incorrect or incomplete, please contact us as soon as possible and we will promptly correct any information errors, all data requests will be processed within 1 month or 30 calendar days.

There are always risks associated with providing personal information, whether in person, by phone or over the Internet no system of technology is completely safe or "hacker proof". O’Neill Wetsuits LTD has endeavoured to put in place security procedures and take appropriate industry standard measures including Antivirus software, Intrusion detection systems, Firewalls, Data Encryption and ongoing staff training to prevent and minimize the risks of unauthorized access to, improper use of and the inaccuracy of your personal information. Furthermore, O’Neill requires that any service providers and third party processors providing services take equal measures.

Use of Forms & information outside of Europe

We may use forms such as our Pre-Order, Account Application and Warranty forms to collect information about you and in some instances some of this information may be transferred to and held at the offices of our group companies O’Neill LLC in Santa Cruz CA. USA.  The data collected by the account application and warranty forms on our website is transferred to and held with Formstack LLC in the USA. Formstack comply with the EU-US Privacy Shield framework, these forms use 256-bit SSL and TLS encryption to ensure the privacy of your information and we will not share your information from these forms with any other parties. Without this information, we will be unable to process your account application or warranty claim.

We may from time to time publish on our website links to other websites that we believe to be of interest, however we have no control over these sites and they are not governed by this privacy policy.

Promotions

Section 8.28.5 of the UK CAP code (UK Code of Non-broadcast Advertising and Direct & Promotional Marketing) requires us to make available the  full name and country of major prize winners of competitions, promotions and if applicable their winning entries, except in the limited circumstances where we are subject to a legal requirement never to publish this information. We do not ask for consent to do this as we believe it is justifiable on the grounds of "Legitimate interests".

If we wish to publish more than just the full name and country of a prize winner or use their information for publicity, we will always ask for consent to do this after they have won. Prize winners have the right to refuse this use of their Information and can do so when contacted by us or by contacting us using any of the methods on the contact page of our website.
